Do not commission me if you plan on turning the image into an NFT or upload it to AI learning machines.[ 005 ] : I won't draw characters with big mecha elements; any type of hate speech; NSFW; suggestive content involving minors; and realism. I'm ok with discussing anything else.
RIGHTS N' DISTRIBUTION
[ 006 ] : Commissioner can re-upload the image with credit given to elqato.[ 007 ] : Artwork cannot be used commercially, as such redistribution for use in printed merchandise or promotional goods, services or social media pages is prohibited, unless discussed with me.[ 008 ] : I reserve all rights to the artwork, including rights of distribution, i.e., posting your commission to my social media or use as an example for my portfolio and pricing lists.**[ 009 ] : You may ask for the commission to be kept private for a set amount of time, such as holidays or gift intended pieces, no artwork will however be kept private indefinitely.[ 010 ] : Editing the commission image yourself or through another artist without my permission is explicitly prohibited _ you may however add effects or crop it for an icon/to fit a page, with credit.[ 011 ] : Refunds are based on how much work has been completed — I do not do full refunds if process for a commission has started.
PROCESS
[ 012 ] : Please provide up to 48 hours for me to contact you regarding a commission order.[ 013 ] : Work will only start after the payment has been received.
You will either be redirected to a commiss.io link or be sent a paypal link / Ko-fi page from where you can pay.
Delivery can go from a day to 2 months — I will let you know when to expect your commission to be finished upon payment.
After accepting the commission you will be given access to the trello queue from where you can track your commission satuts.
Communication can be done through e-mail, twitter, insta, toyhou.se or discord.
[ 014 ] : If you want your piece completed by a certain deadline, rush fees are available and will vary depending on how large your commission is and by how soon you want it completed. Reasonable deadlines will be exempt from rush fees, so please discuss with me prior.[ 015 ] : I ask the customer to provide a clear ref sheet, without watermarks placed on top of the design that might obstruct color picking or character visualization.
If possible, I will ask to provide a description of the character's personality, including any important design aspects so I may properly portrait the character.
[ 016 ] : I can provide work-in-progress images throughout the process, please let me know beforehand if and what you'd like to receive -- for larger commissions they will be provided by default.
CHARACTER DESIGN
[ 012 ] : Do not sell a design you own from me for more than you bought it for unless you have added monetary value via commissions or your own artwork.[ 013 ] : You can edit the design and change them however you like, as you see fit. I encourage buyers to customize the design to their hearts content.[ 013 ] : You are not allowed to make any sort of breeding chart adoptables with my designs.
You may however make/breed designs for story/personal purposes — where the original character must always be linked to the new one and vice versa.
[For TH owners]: This link may never be deleted, even if the ownership for one or both character(s) is transferred.
[ 014 ] : Color picking or taking close inspiration from my designs will results in an immediate block and blacklist.
Blacklisted, aka not allowed to own, buy, sell or trade any of my designs.
[ 014 ] : If you do not follow guidelines for selling and trading you'll be given a warning as a first strike, if it happens a second time I reserve all rights to nullify the ownership of the design if it benefits the case, and at a third attempt you'll be proned to be blacklisted.
